1. Agreement to Terms

Welcome to Hocusdocs. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and Hocusdocs ("we", "us", "our") governing your access to and use of our AI-powered document translation platform.

By creating an account or using our services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our services.

2. Service Description

Hocusdocs provides an AI-powered document translation platform that enables users to:

• Upload documents in various formats (PDF, DOCX, XLSX, and others)
• Receive AI-generated translations preserving document structure and formatting
• Access translation history and download translated documents
• Manage subscription plans and page quotas

Our services are provided "as is" and translations are generated using artificial intelligence technology from OpenAI and Mistral AI.

3. User Registration and Account

3.1 Account Creation

To use Hocusdocs, you must:

• Be at least 16 years of age
• Provide accurate, current, and complete registration information
• Maintain and promptly update your account information
• Verify your email address

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access or security breaches
• Using a strong, unique password

3.3 Account Termination

You may delete your account at any time through your account settings. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions and Payments

4.1 Subscription Plans

We offer various subscription tiers with different page quotas. Current pricing and features are available on our pricing page. Subscription details include:

• Monthly or annual billing cycles
• Page quotas that reset each billing period
• Unused pages do not roll over to the next period

4.2 Payment Processing

All payments are processed securely through Stripe. By subscribing, you authorize us to charge your payment method for the applicable subscription fees.

4.3 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled. You may cancel at any time through your account settings or Stripe's billing portal. Cancellation takes effect at the end of the current billing period.

4.4 Refund Policy

EU/EEA Customers: In accordance with EU consumer protection law, you have a 14-day right of withdrawal from the date of purchase. To exercise this right, contact us at info@hocusdocs.com. Note that if you have used the service during this period, we may deduct a proportionate amount for the services provided.

Other Customers: We offer refunds on a case-by-case basis for technical issues preventing service use. Contact support for assistance.

4.5 Price Changes

We may modify subscription prices with 30 days' advance notice. Price changes will not affect your current billing period.

5. Acceptable Use Policy

When using Hocusdocs, you agree NOT to:

• Upload illegal, harmful, threatening, abusive, or objectionable content
• Infringe upon intellectual property rights of third parties
• Upload documents containing malware, viruses, or malicious code
• Attempt to bypass security measures or access restrictions
• Use the service for spam, phishing, or fraudulent activities
• Resell, redistribute, or commercially exploit the service without authorization
• Use automated tools for mass access beyond normal usage
• Reverse engineer or attempt to extract source code from our service
• Interfere with or disrupt the service or servers
• Violate any applicable laws or regulations

6. Intellectual Property Rights

6.1 Your Content

You retain all ownership rights to documents you upload. By uploading content, you grant us a limited, non-exclusive license to process your documents solely for providing translation services.

6.2 Translated Content

Translations generated by our service belong to you. We do not claim ownership of translated content.

6.3 Our Service

The Hocusdocs platform, including its design, code, algorithms, trademarks, and documentation, is owned by us and protected by intellectual property laws. You may not copy, modify, or create derivative works based on our service.

6.4 Your Responsibility

You are solely responsible for ensuring you have the necessary rights to upload and translate documents. You agree to indemnify us against claims arising from content you upload.

7. Translation Quality Disclaimer

Important: Our translations are generated by artificial intelligence and may contain errors, inaccuracies, or inappropriate content. You acknowledge that:

• AI translations are not guaranteed to be 100% accurate
• Translations should not be used as certified or official translations without professional verification
• For legal, medical, financial, or other critical documents, professional human review is strongly recommended
• Translation quality depends on source document quality and formatting
• We do not guarantee preservation of all formatting elements

8. Limitation of Liability

To the maximum extent permitted by applicable law:

• Our service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.
• We are not liable for errors, inaccuracies, or omissions in translations.
• We are not liable for service interruptions, data loss, or security breaches beyond our reasonable control.
• Our total liability shall not exceed the amount you paid for the service in the 12 months preceding the claim.

EU/EEA Users: Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under applicable law.

9. Indemnification

You agree to indemnify, defend, and hold harmless Hocusdocs and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) content you upload to the service.

10. Service Modifications and Availability

We reserve the right to:

• Modify, suspend, or discontinue any part of the service with reasonable notice
• Perform maintenance that may temporarily affect service availability
• Update features, functionality, and user interface
• Change supported file formats or language pairs

We will provide reasonable notice of material changes that affect your use of the service.

11. Account Suspension and Termination

We may suspend or terminate your account immediately if you:

• Violate these Terms of Service
• Engage in fraudulent or illegal activities
• Fail to pay subscription fees
• Abuse the service or other users
• Are required by law enforcement or legal process

Upon termination, your right to access the service ceases immediately. Document retention policies continue to apply as described in our Privacy Policy.

12. Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which complies with the General Data Protection Regulation (GDPR).

Key data protection features include: automatic document deletion after 30 days, encryption of data in transit and at rest, and your right to access, correct, or delete your data at any time.

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of the European Union and the member state where our primary establishment is located, without regard to conflict of law principles.

13.2 EU Consumer Rights

If you are a consumer in the EU/EEA, you benefit from mandatory provisions of consumer protection laws in your country of residence. Nothing in these Terms affects your statutory rights as a consumer.

13.3 Dispute Resolution

For EU consumers, disputes may be submitted to the Online Dispute Resolution platform provided by the European Commission: https://ec.europa.eu/consumers/odr

14. Changes to Terms

The "Last Updated" date at the top indicates when these Terms were last revised.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and Hocusdocs regarding the service and supersede all prior agreements and understandings.
